This Returns & Refund Policy explains the circumstances in which customers may be eligible for a return, replacement, exchange, repair, store credit, or refund when purchasing Products from SIMJA.

It outlines important information relating to:

  • Consumer guarantees;

  • Faulty or damaged Products;

  • Incorrect Products;

  • Manufacturing defects;

  • Products damaged during transit;

This Returns & Refund Policy applies to all Products sold by SIMJA unless otherwise stated and should be read together with our Terms and Conditions, Shipping Policy, and Privacy Policy, which form part of the agreement between you and SIMJA.

By placing an order through the SIMJA website, you acknowledge that you have read and understood this Returns & Refund Policy and agree to its terms, subject to any rights that cannot lawfully be excluded under applicable consumer protection legislation.

Nothing in this Returns & Refund Policy excludes, restricts, or limits any rights or remedies available to you under applicable consumer protection legislation, including the Consumer Guarantees Act 1993 (New Zealand), Australian Consumer Law, the Consumer Rights Act 2015 (United Kingdom), applicable European Union consumer protection legislation, or other mandatory laws that apply to your purchase.

This Returns & Refund Policy applies to Products and Services supplied by Beamsley & Co Limited, trading as Simja – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits ("SIMJA").

SIMJA is a New Zealand-owned creative business offering original artwork, fine art prints, artist-designed products, educational resources, and other Creative Works to customers in New Zealand and internationally.

Depending on the Product purchased, orders may be:

  • Personally prepared, quality checked, packaged, and dispatched by SIMJA;

  • Manufactured, personalised, packaged, or dispatched by authorised third-party providers on behalf of SIMJA; or

  • Fulfilled using a combination of these methods.

As a result, the eligibility for returns, replacements, exchanges, repairs, refunds, or other remedies may vary depending on:

  • The Product purchased;

  • The manufacturing or fulfilment method used;

  • The nature of the issue reported;

  • The circumstances surrounding the claim; and

  • The consumer protection laws that apply to the purchase.

Nothing in this Returns & Refund Policy changes the contractual relationship between you and SIMJA. Your purchase is made from Beamsley & Co Limited, regardless of how your Product is manufactured, fulfilled, or delivered.

SIMJA is committed to working with customers in good faith and will assess each return or refund request fairly, reasonably, and in accordance with this Policy, our Terms and Conditions, and applicable consumer protection legislation.

 

 

3. Products Covered

This Returns & Refund Policy applies to all Products sold by SIMJA through our website unless otherwise stated.

Products covered by this Returns & Refund Policy may include, but are not limited to:

  • Original Artwork;

  • Fine Art Prints;

  • Canvas Prints;

  • Artist-designed footwear;

  • Apparel;

  • Accessories;

  • Home décor;

  • Lifestyle products;

  • Educational resources and educational products;

  • Digital products;

  • Gift cards;

  • Limited edition collections;

  • Special releases;

  • Seasonal collections; and

  • Any other Products introduced by SIMJA from time to time.

Because SIMJA offers a diverse range of Products, the availability of returns, replacements, repairs, exchanges, refunds, store credit, or other remedies may vary depending on:

  • The Product purchased;

  • Whether the Product is an Original Artwork, Fine Art Print, handmade, made-to-order, personalised, or print-on-demand Product;

  • The manufacturing or fulfilment method used;

  • The nature of the issue reported;

  • Whether the Product has been used, altered, damaged, or incorrectly cared for after delivery;

  • The time elapsed since delivery;

  • The evidence provided to support the claim; and

  • The consumer protection laws applicable to the purchase.

Certain Products may be subject to additional conditions due to their unique nature, including Original Artwork, Limited Edition Products, personally prepared Products, made-to-order Products, personalised Products, digital Products, Gift Cards, and Products manufactured by authorised third-party providers.

Specific return conditions for these Product categories are explained throughout this Returns & Refund Policy.

As SIMJA continues to grow, we may introduce new Products, collections, technologies, manufacturing methods, fulfilment services, or digital offerings. Unless otherwise stated, this Returns & Refund Policy will apply to those Products and Services.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

 

4. Consumer Rights

SIMJA is committed to complying with applicable consumer protection laws in the jurisdictions where our Products are sold.

Nothing in this Returns & Refund Policy, our Terms and Conditions, or any other SIMJA policy is intended to exclude, restrict, or limit any rights, guarantees, warranties, remedies, or protections that cannot lawfully be excluded under applicable legislation.

Where mandatory consumer protection laws provide customers with rights that are more favourable than those described in this Returns & Refund Policy, those statutory rights will prevail to the extent required by law.

Depending on the circumstances of your purchase, applicable consumer protection legislation may include, but is not limited to:

  • Consumer Guarantees Act 1993 (New Zealand);

  • Fair Trading Act 1986 (New Zealand);

  • Australian Consumer Law, contained in the Competition and Consumer Act 2010 (Cth);

  • Consumer Rights Act 2015 (United Kingdom);

  • Applicable European Union consumer protection legislation, including mandatory consumer rights applicable within EU Member States; and

  • Any other mandatory consumer protection, ecommerce, or sale of goods legislation applicable in the jurisdiction where your purchase is made or your Products are supplied.

Where a Product fails to meet applicable statutory guarantees or consumer rights, SIMJA will provide an appropriate remedy in accordance with the relevant legislation and the circumstances of the individual claim.

Depending on the applicable law and the nature of the issue, an appropriate remedy may include:

  • Repair;

  • Replacement;

  • Refund;

  • Price reduction;

  • Store credit where mutually agreed; or

  • Another remedy required by applicable law.

Nothing in this Returns & Refund Policy affects your ability to seek any remedy available under mandatory consumer protection legislation.

Where this Returns & Refund Policy provides customers with rights or benefits that exceed those required by applicable law, SIMJA may apply those additional benefits at its discretion, provided doing so does not reduce or affect any mandatory statutory rights.

 

 

5. Change of Mind

SIMJA understands that customers may occasionally change their mind after placing an order.

Because many of our Products are individually created, artist-produced, personalised, made to order, or manufactured specifically for each customer, we are unable to accept all change-of-mind returns.

This section explains when a change-of-mind return may be available and when it may not.

Nothing in this Returns & Refund Policy excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

What Is a Change-of-Mind Return?

A change-of-mind return refers to a request to cancel, return, exchange, or obtain a refund for a Product where there is no manufacturing fault, damage, incorrect supply, or other issue giving rise to rights under applicable consumer protection legislation.

Examples include where a customer:

  • Changes their mind after placing an order;

  • Orders the incorrect Product, size, colour, style, or design;

  • No longer requires the Product;

  • Orders in error; or

  • Wishes to return a Product for personal preference.

 

Products That Are Generally Not Eligible for Change-of-Mind Returns

Unless required by applicable law or expressly approved by SIMJA, change-of-mind returns are generally not available for:

  • Original Artwork;

  • Commissioned Artwork;

  • Fine Art Prints that are signed, numbered, personalised, or produced as limited editions;

  • Made-to-order Products;

  • Print-on-demand Products;

  • Personalised or customised Products;

  • Products manufactured specifically for an individual customer;

  • Digital Products, downloadable content, or digital licences once delivery has commenced;

  • Gift Cards;

  • Products that have been used, worn, washed, altered, damaged, or modified after delivery;

  • Products that cannot reasonably be resold as new due to their condition; and

  • Any Product identified on the Product page as non-returnable.

 

Hygiene and Product Integrity

To protect the health, safety, and confidence of all customers, certain Products may not be eligible for a change-of-mind return once they have been worn, used, or opened where doing so would affect their suitability for resale.

Depending on the Product purchased, this may include:

  • Apparel;

  • Footwear;

  • Headwear;

  • Wearable accessories; and

  • Other Products where hygiene, safety, or product integrity would reasonably be compromised.

This does not affect any rights relating to faulty, damaged, or incorrectly supplied Products.

 

Original Artwork and Fine Art Prints

Original Artwork and Fine Art Prints are carefully created, selected, or prepared by SIMJA and may be unique, limited edition, signed, or accompanied by a Certificate of Authenticity.

Because of their unique artistic nature and limited availability, change-of-mind returns are generally not accepted unless required by applicable law or otherwise agreed by SIMJA in writing.

 

Made-to-Order and Print-on-Demand Products

Many SIMJA Products are individually manufactured after an order has been accepted.

Production may begin shortly after payment has been successfully authorised.

Once production has commenced, change-of-mind cancellations, returns, or exchanges may no longer be possible.

Customers are encouraged to carefully review product descriptions, sizing information, colour selections, personalisation details, and shipping information before completing their purchase.

 

Digital Products

Where SIMJA offers digital Products, including downloadable artwork, educational resources, digital content, templates, or other electronic goods, change-of-mind refunds are generally unavailable once access has been granted, delivery has commenced, or the Product has been downloaded, unless otherwise required by applicable law.

 

Case-by-Case Consideration

SIMJA recognises that every situation is unique.

Where appropriate, and where consistent with applicable law, we may consider change-of-mind requests on a case-by-case basis.

Any approval of a return, exchange, refund, or other remedy outside this Policy is made entirely at SIMJA's discretion and does not create an obligation to approve similar requests in the future.

 

6. Faulty Products

SIMJA is committed to providing high-quality Products that are carefully designed, created, manufactured, prepared, and supplied.

If a Product is faulty, contains a manufacturing defect, arrives damaged (other than damage caused after delivery), or fails to meet applicable statutory consumer guarantees, SIMJA will work with the customer to provide an appropriate remedy in accordance with this Returns & Refund Policy, our Terms and Conditions, and applicable consumer protection legislation.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable law.

 

What Is a Faulty Product?

A Product may be considered faulty where it:

  • Contains a manufacturing defect;

  • Has a material defect affecting its intended use;

  • Differs materially from its description or approved specifications;

  • Is not of acceptable quality where required by applicable law;

  • Is not fit for its intended purpose where applicable consumer guarantees apply; or

  • Contains another defect that gives rise to a remedy under applicable consumer protection legislation.

Each claim will be assessed on its individual circumstances.

 

Manufacturing Defects

Manufacturing defects may include, where applicable:

  • Incorrect printing;

  • Significant print quality defects;

  • Incorrect assembly;

  • Material defects;

  • Structural defects;

  • Significant stitching or construction faults;

  • Incorrect product customisation;

  • Incorrectly manufactured Product variants; or

  • Other production faults that materially affect the Product.

Minor manufacturing tolerances and natural variations that are inherent in handmade, artist-created, or print-on-demand Products are addressed separately in this Returns & Refund Policy and do not, by themselves, constitute a manufacturing defect.

 

Products Damaged Before or During Delivery

If a Product arrives damaged before or during delivery, customers should contact SIMJA as soon as reasonably practicable.

To assist with our investigation, customers may be asked to provide:

  • The order number;

  • A description of the issue;

  • Clear photographs of the Product;

  • Photographs of the packaging and shipping label;

  • Photographs showing the damage; and

  • Any other information reasonably required to investigate the claim.

Customers should retain the Product and original packaging until advised otherwise where this is reasonably required for an investigation.

 

Quality Concerns

If a customer believes that a Product does not meet SIMJA's expected quality standards, they are encouraged to contact us promptly.

Quality concerns may include matters such as:

  • Significant manufacturing defects;

  • Material quality issues;

  • Functional defects;

  • Incorrect production; or

  • Other issues affecting the Product's intended use.

Each quality concern will be assessed individually based on the Product, the reported issue, the evidence provided, and the requirements of applicable consumer protection legislation.

 

Investigation and Assessment

SIMJA may undertake a reasonable investigation before determining an appropriate remedy.

This may include:

  • Reviewing the original order;

  • Assessing photographs or other supporting evidence;

  • Consulting with authorised third-party providers;

  • Reviewing manufacturing records;

  • Confirming production specifications; and

  • Requesting additional information where reasonably necessary.

The time required to complete an assessment may vary depending on the nature of the issue.

 

Available Remedies

Where SIMJA confirms that a Product is faulty or a remedy is otherwise required under applicable law, we will provide an appropriate remedy.

Depending on the circumstances, this may include:

  • Repair;

  • Replacement;

  • Refund;

  • Price reduction where applicable;

  • Store credit where mutually agreed; or

  • Another remedy required by applicable consumer protection legislation.

The appropriate remedy will depend on the nature of the fault, the Product involved, the availability of replacement stock, and the requirements of applicable law.

 

Exclusions

A Product will not generally be considered faulty where the issue arises solely from:

  • Normal wear and tear;

  • Accidental damage after delivery;

  • Misuse;

  • Improper care or cleaning;

  • Failure to follow care instructions;

  • Unauthorised alteration or repair;

  • Damage caused by the customer or another third party after delivery; or

  • Characteristics that are normal for handmade, artist-created, or print-on-demand Products and are explained elsewhere in this Returns & Refund Policy.

These exclusions do not apply where a remedy is required under applicable consumer protection legislation.

 

7. Incorrect Products

SIMJA takes reasonable care to ensure that every order is accurately manufactured, prepared, packed, and dispatched.

If you believe you have received an incorrect Product or that there has been an error in fulfilling your order, please contact SIMJA as soon as reasonably practicable so that we can investigate and, where appropriate, provide an appropriate remedy.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

What Is an Incorrect Product?

An incorrect Product may include circumstances where:

  • The wrong Product has been supplied;

  • The incorrect size has been supplied;

  • The incorrect colour, style, or Product variant has been supplied;

  • The wrong artwork or design has been printed or applied;

  • The Product differs materially from the confirmed order;

  • The wrong personalisation or customisation has been applied;

  • An item is missing from the order after allowing reasonable time for all shipments to arrive; or

  • Another fulfillment error has occurred.

Each report will be assessed on its individual circumstances.

 

Reporting an Incorrect Product

If you believe there has been a fulfilment error, please contact SIMJA as soon as reasonably practicable.

To assist with our investigation, we may request:

  • Your order number;

  • A description of the issue;

  • Clear photographs of the Product received;

  • Photographs of any labels, packaging, or shipping documentation;

  • Photographs showing the alleged error where applicable; and

  • Any other information reasonably required to investigate the matter.

Providing complete information helps us resolve your request more efficiently.

 

Split Shipments

Many SIMJA orders are fulfilled from multiple manufacturing or dispatch locations.

As explained in our Shipping Policy, Products within the same order may be:

  • Manufactured separately;

  • Dispatched from different fulfilment centres;

  • Shipped from different countries;

  • Sent using different shipping carriers; and

  • Delivered on different dates.

Before reporting a missing item, customers should allow reasonable time for all shipments associated with their order to arrive and review any tracking information provided.

Receiving part of an order before the remaining items is a normal part of SIMJA's fulfilment process and does not necessarily indicate that an item has been omitted.

 

Investigation

SIMJA will investigate all reports of incorrect Products fairly and in good faith.

Depending on the circumstances, we may:

  • Review the original order;

  • Compare production and fulfilment records;

  • Consult with authorised third-party providers;

  • Review shipping records and tracking information;

  • Request additional supporting information; or

  • Assess photographs or other evidence provided.

The time required to complete an investigation may vary depending on the nature of the issue.

 

Available Remedies

Where our investigation confirms that an incorrect Product has been supplied or another fulfillment error has occurred, SIMJA will provide an appropriate remedy in accordance with this Returns & Refund Policy, our Terms and Conditions, and applicable consumer protection legislation.

Depending on the circumstances, an appropriate remedy may include:

  • Repair, where appropriate;

  • Replacement;

  • Refund;

  • Store credit where mutually agreed; or

  • Another remedy required by applicable law.

The remedy provided will depend on the nature of the fulfilment error, the Product involved, and the requirements of applicable consumer protection legislation.

 

Customer Responsibilities

Customers are encouraged to inspect their order promptly upon delivery and notify SIMJA of any fulfilment issues as soon as reasonably practicable.

Prompt notification helps us investigate the matter while production, fulfilment, and shipping records remain available and allows us to work with our authorised third-party providers where necessary to resolve the issue efficiently.

 

 

8. Products Damaged During Shipping

SIMJA takes great care to ensure that Products are appropriately packaged for transport.

Despite these precautions, damage may occasionally occur while a shipment is being handled or transported by a shipping carrier.

If your Product arrives damaged during shipping, please contact SIMJA as soon as reasonably practicable so that we can investigate the matter and, where appropriate, provide an appropriate remedy.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

Reporting Shipping Damage

Customers should inspect their order as soon as reasonably practicable after delivery.

If a Product appears to have been damaged during transit, customers should notify SIMJA promptly.

To assist with our investigation, we may request:

  • Your order number;

  • A description of the damage;

  • Clear photographs of the damaged Product;

  • Photographs of the external packaging;

  • Photographs of the internal packaging;

  • Photographs of the shipping label;

  • Photographs clearly showing any visible impact damage; and

  • Any other information reasonably required to investigate the claim.

Where reasonably practicable, customers should retain the damaged Product and all original packaging until the investigation has been completed or SIMJA advises otherwise.

 

Reporting Timeframe

To assist with courier investigations, customers should report shipping damage as soon as reasonably practicable after delivery.

Prompt reporting helps preserve shipping records and enables SIMJA to work more effectively with shipping carriers, authorised third-party providers, and insurers.

While delayed reporting will not automatically prevent a claim from being considered, it may affect our ability to investigate the matter or recover compensation from the relevant shipping provider.

Nothing in this section limits any statutory rights available under applicable consumer protection legislation.

 

Investigation

Depending on the nature of the damage, SIMJA may investigate the matter with the relevant shipping carrier, authorised third-party provider, fulfilment partner, or shipping insurer.

The investigation may include:

  • Reviewing order and dispatch records;

  • Reviewing tracking information;

  • Assessing the photographs and supporting evidence provided;

  • Requesting additional information where reasonably necessary;

  • Liaising with authorised third-party providers;

  • Submitting a carrier or insurance claim where appropriate; and

  • Taking any other reasonable steps necessary to determine the cause of the damage.

The timeframe for completing an investigation will depend on the procedures of the relevant shipping carrier, fulfilment provider, or insurer.

 

Packaging

SIMJA and our authorised third-party providers use packaging designed to provide appropriate protection during normal transportation.

Damage sustained during transit does not necessarily indicate that a Product was incorrectly manufactured or inadequately packaged.

Shipping damage may occur due to circumstances beyond SIMJA's reasonable control, including carrier handling, transportation incidents, customs inspections, weather events, or other events occurring after dispatch.

Regardless of the cause, SIMJA will work in good faith with customers and our fulfillment partners to investigate genuine shipping damage and determine an appropriate resolution.

 

Available Remedies

Where our investigation confirms that a Product has been damaged during shipping, or where a remedy is otherwise required under applicable consumer protection legislation, SIMJA will provide an appropriate remedy.

Depending on the circumstances, this may include:

  • Repair, where appropriate;

  • Replacement of the Product;

  • Refund;

  • Price reduction where applicable;

  • Store credit where mutually agreed; or

  • Another remedy required by applicable law.

The appropriate remedy will depend on the nature of the damage, the Product involved, replacement availability, and the requirements of applicable consumer protection legislation.

 

Customer Cooperation

Customers agree to provide reasonable assistance during the investigation of shipping damage claims, including supplying supporting information or evidence where reasonably requested.

Providing complete and accurate information helps SIMJA resolve claims more efficiently and, where applicable, seek compensation from shipping carriers or insurers without affecting the customer's statutory rights.

 

9. Original Artwork

Original Artwork occupies a unique place within the SIMJA collection. Each piece represents an original creative work and may be produced as a one-of-a-kind artwork or as part of a limited edition collection.

Due to the unique nature of Original Artwork, additional terms apply to its sale, handling, and any request for a return, replacement, or refund.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

One-of-a-Kind Artwork

Many Original Artwork pieces created by SIMJA are unique and cannot be reproduced exactly.

Natural characteristics of the artistic process, including brushwork, texture, layering, mixed media techniques, hand-finishing, and other artistic elements, form part of the originality of each piece and are not defects.

Where a one-of-a-kind Original Artwork is no longer available, an identical replacement cannot be provided.

 

Authenticity

SIMJA takes reasonable steps to ensure the authenticity of all Original Artwork offered for sale.

Original Artwork may include identifying features such as:

  • The artist's signature;

  • Dates of creation;

  • Edition numbers where applicable;

  • Certificates of Authenticity;

  • Artist markings; or

  • Other identifying characteristics determined by SIMJA.

Customers should retain all authenticity documentation supplied with their purchase, as replacement documentation may not always be available.

 

Certificates of Authenticity

Where a Certificate of Authenticity accompanies an Original Artwork, it forms part of the provenance of the artwork.

Customers are encouraged to store Certificates of Authenticity safely.

Loss, damage, or destruction of a Certificate of Authenticity does not affect ownership of the artwork, but replacement certificates may not be available or may only be issued at SIMJA's discretion.

 

Packaging and Handling

Original Artwork is carefully inspected, packaged, and prepared for shipment to help minimise the risk of damage during transportation.

Upon delivery, customers should:

  • Carefully inspect the external packaging before opening;

  • Handle the artwork with appropriate care;

  • Avoid unnecessary exposure to moisture, excessive heat, direct sunlight, or physical impact; and

  • Follow any care or handling instructions provided by SIMJA.

Customers should retain the original packaging until they are satisfied that the artwork has arrived in good condition.

 

Condition Upon Delivery

Customers are encouraged to inspect Original Artwork as soon as reasonably practicable after delivery.

If an artwork appears to have been damaged during shipping or differs materially from the order placed, customers should contact SIMJA promptly and provide reasonable supporting evidence, including photographs of:

  • The artwork;

  • The front and back of the artwork where applicable;

  • The external packaging;

  • The internal packaging;

  • The shipping label; and

  • Any visible damage.

This information assists SIMJA in investigating the matter with shipping carriers or authorised third-party providers where appropriate.

 

Returns and Remedies

Because many Original Artwork pieces are unique, one-of-a-kind, commissioned, or produced in limited quantities, replacement may not always be possible.

Where a remedy is required under applicable consumer protection legislation, or where SIMJA determines that a return, replacement, repair, refund, or other remedy is appropriate, the available resolution will depend on the individual circumstances of the claim and the availability of the artwork.

Where an identical replacement is unavailable, SIMJA may, where appropriate:

  • Offer a comparable replacement artwork with the customer's agreement;

  • Repair the artwork where reasonably possible;

  • Provide a refund;

  • Offer store credit where mutually agreed; or

  • Provide another remedy required by applicable law.

 

Customer Responsibilities

Customers are responsible for handling and caring for Original Artwork appropriately after delivery.

SIMJA is not responsible for damage resulting from:

  • Improper handling after delivery;

  • Inappropriate storage;

  • Accidental damage;

  • Unauthorised cleaning, restoration, framing, or alteration;

  • Exposure to unsuitable environmental conditions; or

  • Other damage occurring after the artwork has been successfully delivered.

This does not affect any rights available under applicable consumer protection legislation.

 

10. Fine Art Prints

SIMJA offers professionally produced Fine Art Prints featuring reproductions of Original Artwork created by the artist.

Each Fine Art Print is produced to showcase the original artwork as accurately as reasonably possible while recognising that slight variations may occur as part of the professional printing process.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

Personally Prepared and Packaged

Unless otherwise stated, Fine Art Prints are personally inspected, quality checked, carefully packaged, and dispatched by SIMJA from New Zealand.

Each print is prepared with the aim of helping it arrive safely and in excellent condition.

Packaging methods may change from time to time as SIMJA continues to improve product protection and sustainability.

 

Signed Editions

Some Fine Art Prints may be supplied with the artist's original signature.

Where a print is advertised as signed, the signature forms part of that individual edition.

Signed prints should be handled with appropriate care to preserve their condition and long-term value.

 

Limited Editions

Certain Fine Art Prints may be released as limited editions.

Customers are encouraged to retain Certificates of Authenticity in a safe place.

Loss or damage to a Certificate of Authenticity does not affect ownership of the artwork; however, replacement certificates may not always be available and may only be issued at SIMJA's discretion.

 

Packaging and Inspection

Before dispatch, Fine Art Prints are inspected to help ensure they meet SIMJA's quality standards.

Customers are encouraged to inspect their order as soon as reasonably practicable after delivery.

If a Fine Art Print appears to have been damaged during shipping or differs materially from the order placed, customers should contact SIMJA promptly and provide reasonable supporting evidence, including photographs of:

  • The Fine Art Print;

  • The front and back of the print where applicable;

  • The external packaging;

  • The internal packaging;

  • The shipping label; and

  • Any visible damage.

Customers should retain the original packaging until the investigation has been completed or SIMJA advises otherwise.

 

Natural Characteristics

Fine Art Prints are professionally reproduced from Original Artwork.

Reasonable variations in colour, texture, finish, paper characteristics, or other printing attributes may occur due to differences in printing processes, materials, lighting conditions, and display devices.

These natural variations do not, by themselves, constitute a manufacturing fault or defect.

Available Remedies

Where a Fine Art Print is confirmed to be faulty, incorrectly supplied, damaged during shipping, or otherwise fails to meet applicable statutory consumer guarantees, SIMJA will provide an appropriate remedy in accordance with this Returns & Refund Policy, our Terms and Conditions, and applicable consumer protection legislation.

Depending on the circumstances, this may include:

  • Replacement;

  • Repair where appropriate;

11. Print-on-Demand Products

Many SIMJA Products are manufactured using print-on-demand ("POD") production methods.

Rather than being held as finished inventory, these Products are individually manufactured after an order has been accepted and payment has been successfully authorised.

SIMJA works with carefully selected authorised third-party providers to manufacture, personalise, package, and dispatch many of our Products.

Our authorised providers currently include companies such as Printful and POPCUSTOMS, together with any other authorised fulfilment partners engaged by SIMJA from time to time.

Nothing in this section excludes, restricts, or limits any rights or remedies available under applicable consumer protection legislation.

 

Individually Manufactured Products

Print-on-demand Products are produced specifically for each customer.

Depending on the Product, this may include:

  • Rights to create derivative works; or

  • Any other intellectual property rights relating to the Creative Work.

Customers receive ownership only of the Product purchased.

Returns and Refunds

AI-assisted Creative Works are assessed under this Returns & Refund Policy in the same manner as all other Products.

The use of AI during the creative process does not, by itself, make a Product faulty, defective, or eligible for a return, replacement, exchange, or refund.

Unless otherwise agreed or required by applicable law, approved refunds will be issued using the original payment method used to complete the purchase.

If the original payment method is no longer available, SIMJA may work with the customer to arrange an alternative refund method where reasonably practicable and permitted by law.

 

Refund Processing Timeframes

Once a refund has been approved, SIMJA will make reasonable efforts to process it as soon as reasonably practicable.

After a refund has been processed by SIMJA, the time taken for the funds to appear in the customer's account will depend on:

  • The payment provider;

  • The customer's financial institution;

  • The payment method used; and

  • Banking or payment processing timeframes.

SIMJA is not responsible for delays caused by banks, payment providers, or other financial institutions after a refund has been processed.

 

Full and Partial Refunds

Depending on the circumstances, a customer may be entitled to:

  • A full refund;

  • A partial refund;

  • A price reduction;

  • Store credit where mutually agreed;

  • A replacement Product; or

  • Another remedy required by applicable consumer protection legislation.

The appropriate remedy will be determined based on the nature of the issue and the requirements of applicable law.

 

Shipping Charges

Where a refund relates to a faulty Product, an incorrectly supplied Product, or another issue for which SIMJA is responsible, any refund of shipping charges will be determined in accordance with applicable consumer protection legislation and the circumstances of the purchase.

For approved change-of-mind returns, original shipping charges are generally non-refundable unless otherwise required by applicable law or expressly agreed by SIMJA.

Customs Duties, Taxes and Fees

Refunds generally apply only to amounts paid directly to SIMJA.

Customs duties, import taxes, VAT, GST, brokerage fees, customs clearance charges, and similar government-imposed fees collected by customs authorities, shipping carriers, or other third parties are generally outside SIMJA's control and may not be refundable by SIMJA.

Customers seeking a refund of such charges may need to contact the relevant customs authority, government agency, shipping carrier, or payment provider, depending on the circumstances.

 

Currency

SIMJA may display or accept payments in different currencies depending on the customer's location, payment method, or website settings.

Approved refunds will generally be processed in the same currency in which the original payment was received.

SIMJA is not responsible for differences resulting from:

  • Exchange rate fluctuations;

  • Currency conversion;

  • Bank fees;

  • Credit card fees;

  • Payment provider fees; or

  • Foreign transaction charges.

These amounts are determined by the customer's financial institution or payment provider and are outside SIMJA's control.

 

Refund Notifications

Where a refund is approved, SIMJA will notify the customer that the refund has been processed.

Customers should retain this confirmation until the refunded amount has been received.

If a refund has not appeared within a reasonable period after processing, customers should first contact their payment provider or financial institution before contacting SIMJA.

 

Alternative Remedies

A refund may not always be the most appropriate remedy.

Depending on the circumstances and applicable consumer protection legislation, SIMJA may instead provide:

  • A repair;

  • A replacement;

  • A price reduction;

  • Store credit where mutually agreed; or

  • Another remedy required by applicable law.

Each request will be assessed individually to determine the most appropriate resolution.

 

 

20. Replacements

Where a Product is confirmed to be faulty, incorrectly supplied, damaged during shipping, or otherwise eligible for a remedy under this Returns & Refund Policy or applicable consumer protection legislation, SIMJA will determine the most appropriate remedy having regard to the circumstances of the individual claim and the requirements of applicable law.

Where appropriate and reasonably practicable, a replacement Product may be offered as the preferred remedy.

 

Replacement Priority

Where a replacement Product is available and suitable, SIMJA may choose to replace the Product rather than provide another remedy.

Replacement may be appropriate where:

  • A Product contains a manufacturing defect;

  • An incorrect Product has been supplied;

  • A Product has been damaged during shipping;

  • A fulfilment error has occurred; or

  • Another issue can reasonably be resolved by supplying a replacement Product.

The availability of a replacement will depend on the Product involved and the circumstances of the claim.

 

Product Availability

Replacement Products are subject to availability.

Some Products offered by SIMJA, including Original Artwork, Limited Edition Products, seasonal collections, discontinued Products, or Products manufactured by authorised third-party providers, may no longer be available at the time a claim is assessed.

Where an identical replacement is unavailable, SIMJA will determine an appropriate alternative remedy having regard to the individual circumstances of the claim and applicable consumer protection legislation.

 

Alternative Remedies

Where an identical replacement cannot reasonably be provided, SIMJA may, where appropriate:

  • Repair the Product;

  • Supply a comparable replacement Product with the customer's agreement;

  • Provide a refund;

  • Offer a price reduction where applicable;

  • Offer store credit where mutually agreed; or

  • Provide another remedy required by applicable consumer protection legislation.

The remedy provided will depend on factors including Product availability, the nature of the issue, and the requirements of applicable law.

 

Replacement Production and Delivery

Replacement Products may require manufacturing before dispatch, particularly where they are produced using print-on-demand or other made-to-order production methods.

Where a replacement Product must be manufactured, normal production and shipping timeframes may apply.

SIMJA will make reasonable efforts to process approved replacement orders as promptly as reasonably practicable.

 

Original Artwork and Limited Editions

Because many Original Artwork pieces and Limited Edition Products are unique or produced in restricted quantities, an identical replacement may not always be possible.

Where this occurs, SIMJA will discuss the available options with the customer and determine an appropriate remedy in accordance with this Returns & Refund Policy and applicable consumer protection legislation.

 

Customer Communication

SIMJA will keep customers reasonably informed throughout the replacement process and will advise if additional information, photographs, or the return of the original Product is required before a replacement can be issued.

 

 

21. Exchanges

SIMJA understands that customers may occasionally wish to exchange a Product.

Because many SIMJA Products are individually manufactured, made to order, personalised, artist-created, or produced in limited quantities, exchanges are not always possible.

Exchange requests will be considered on a case-by-case basis, having regard to the individual circumstances of the request, Product availability, and applicable consumer protection legislation.

 

When Exchanges May Be Available

Where reasonably practicable, SIMJA may offer an exchange where:

  • An incorrect Product has been supplied;

  • An incorrect size has been supplied due to a manufacturing or fulfilment error;

  • A Product contains a confirmed manufacturing defect;

  • A Product has been damaged during shipping;

  • An exchange represents the most appropriate remedy under applicable consumer protection legislation; or

  • SIMJA otherwise agrees to an exchange.

The availability of an exchange will depend on the Product involved and replacement stock or manufacturing availability.

 

Products Generally Not Eligible for Exchange

Unless required by applicable consumer protection legislation or expressly approved by SIMJA, exchanges are generally not available for:

  • Original Artwork;

  • Commissioned Artwork;

  • Personalised or customised Products;

  • Made-to-order Products;

  • Print-on-demand Products;

  • Signed or Limited Edition Products;

  • Digital Products;

  • Gift Cards; or

  • Products that have been used, worn, washed, altered, damaged, or modified after delivery.

 

Size Exchanges

Customers are encouraged to carefully review the Product description, measurements, and size guide before placing an order.

Where the correct size has been supplied as ordered, requests to exchange a Product solely because a different size is preferred will generally be treated as a change-of-mind request and will be assessed in accordance with the Change of Mind section of this Returns & Refund Policy.

Where an incorrect size has been supplied due to a manufacturing or fulfilment error, SIMJA will investigate the matter and determine the most appropriate remedy.

 

Exchange Process

Where an exchange is approved, SIMJA will provide instructions explaining:

  • Whether the original Product must be returned;

  • The return address (if applicable);

  • Any required supporting information;

  • Any applicable return shipping arrangements; and

  • The next steps for processing the exchange.

Exchange Products may be subject to normal production and shipping timeframes, particularly where replacement Products are manufactured to order.

 

Alternative Remedies

Where an exchange is unavailable or is not the most appropriate remedy, SIMJA may instead determine another suitable resolution having regard to the circumstances of the individual claim.

Depending on the circumstances, this may include:

  • Repair;

  • Store credit where mutually agreed; or

22. Cancellations

SIMJA understands that customers may occasionally need to cancel an order.

As many SIMJA Products are individually manufactured, artist-created, made to order, or personally prepared after an order is placed, cancellation requests cannot always be accommodated.

Cancellation requests will be assessed on a case-by-case basis, having regard to the stage of production, the nature of the Product, the fulfilment process, and applicable consumer protection legislation.

 

Before Production

Customers wishing to cancel an order should contact SIMJA as soon as reasonably practicable after placing the order.

Where production has not commenced and the order has not been committed to manufacture or fulfilment, SIMJA will make reasonable efforts to accommodate the cancellation request.

If a cancellation is approved before production begins, the customer may be entitled to:

  • A full refund;

  • A partial refund where costs have already been incurred; or

  • Another appropriate remedy, depending on the circumstances of the order.

 

After Production Has Commenced

Once production has commenced, cancellation may no longer be possible.

Many SIMJA Products are individually manufactured specifically for each customer using print-on-demand or other made-to-order production methods.

Once an order has entered production, manufacturing costs may already have been incurred and the Product may no longer be suitable for resale.

Where production has commenced, SIMJA will determine whether cancellation remains reasonably practicable having regard to:

  • The stage of production;

  • The Product ordered;

  • The manufacturing method used;

  • The policies and processes of the authorised third-party provider;

  • Costs already incurred; and

  • Applicable consumer protection legislation.

 

After Dispatch

Once an order has been dispatched, it generally cannot be cancelled.

If a customer no longer wishes to receive the Product after dispatch, any available remedies will be determined in accordance with this Returns & Refund Policy, the Shipping Policy, our Terms and Conditions, and applicable consumer protection legislation.

Customers should not refuse delivery solely for the purpose of obtaining a refund, as additional shipping charges, customs fees, return shipping costs, or other charges may be incurred depending on the circumstances.

 

Made-to-Order, Personalised and Custom Products

Products manufactured specifically for a customer, including made-to-order, personalised, customised, commissioned, print-on-demand, or artist-created Products, generally cannot be cancelled once production has commenced unless otherwise required by applicable consumer protection legislation.

Customers are encouraged to carefully review:

  • Product descriptions;

  • Size guides;

  • Colour selections;

  • Personalisation details;

  • Shipping information; and

  • Order information

before completing their purchase.

 

Cancellation Requests

All cancellation requests should be submitted to SIMJA as soon as reasonably practicable.

Providing prompt notice gives the best opportunity for an order to be cancelled before production or dispatch.

SIMJA will consider every cancellation request fairly and in good faith, having regard to the individual circumstances of the request, the stage of fulfilment, and applicable consumer protection legislation.

 

Refunds Following Cancellation

  • Another circumstance beyond SIMJA's reasonable control prevented successful delivery.

Where a shipment is returned, SIMJA will review the circumstances and determine the most appropriate course of action.

 

Re-delivery

Where reasonably practicable, SIMJA may offer to resend a returned shipment.

Before re-dispatch, customers may be required to:

  • Confirm or update their delivery address;

  • Pay any additional shipping costs;

  • Pay any customs or government charges not previously paid; and

  • Provide any additional information reasonably required to complete delivery.

Re-dispatched orders may be subject to normal production, processing, and shipping timeframes where a replacement Product must be manufactured.

 

Refunds for Returned Shipments

Where a returned shipment results from circumstances within the customer's control, including refusal of delivery without lawful justification, failure to collect the shipment, failure to provide an accurate delivery address, or failure to comply with import requirements, SIMJA may reduce any refund by the reasonable costs incurred, where permitted by applicable consumer protection legislation.

Where a return results from an error by SIMJA, an authorised third-party provider, or the shipping carrier, SIMJA will determine the appropriate remedy having regard to the circumstances of the individual claim and applicable consumer protection legislation.

 

Communication

Customers are encouraged to contact SIMJA promptly if they become aware of any issue that may affect delivery.

Early communication may allow SIMJA or the relevant shipping provider to resolve the issue before the shipment is returned.

SIMJA will work in good faith with customers and our authorised third-party providers to determine a fair and reasonable outcome where a shipment has been refused or returned.

 

 

24. Chargebacks and Payment Disputes

SIMJA encourages customers to contact us directly if they experience any issue with their order.

In many cases, concerns can be resolved more quickly through direct communication than through a payment dispute or chargeback process.

Contact SIMJA First

Before initiating a chargeback or payment dispute, customers are encouraged to contact SIMJA to allow us a reasonable opportunity to investigate and resolve the issue.

Depending on the circumstances, SIMJA may be able to offer:

  • Repair;

  • Replacement;

  • Exchange;

  • Refund;

  • Store credit where mutually agreed; or

  • Another appropriate remedy consistent with this Returns & Refund Policy and applicable consumer protection legislation.

 

Chargeback Investigations

Where a payment dispute or chargeback is initiated, SIMJA may investigate the transaction and provide relevant information to the payment provider, financial institution, or card issuer.

This information may include, where applicable:

  • Order confirmation records;

  • Payment records;

  • Customer communications;

  • Production records;

  • Manufacturing records;

  • Fulfilment records;

  • Shipping and tracking information;

  • Delivery confirmations;

  • Photographs provided by the customer;

  • Product photographs taken during production or fulfilment;

  • Carrier delivery records;

  • Customs documentation;

  • Return records; and

  • Any other information reasonably relevant to the investigation.

 

False or Misleading Claims

SIMJA reserves the right to dispute chargebacks or payment disputes where there is reasonable evidence that:

  • A Product was correctly manufactured and supplied;

  • Delivery was completed in accordance with the shipping carrier's delivery procedures;

  • The claim is inconsistent with the available evidence;

  • False, misleading, or incomplete information has been provided; or

  • A chargeback has been initiated contrary to this Returns & Refund Policy, our Terms and Conditions, or applicable consumer protection legislation.

Nothing in this section prevents a customer from exercising any rights available under applicable law.

 

Resolution of Genuine Issues

SIMJA is committed to resolving genuine customer concerns fairly and in good faith.

Where a Product is confirmed to be faulty, incorrectly supplied, damaged during shipping, or otherwise eligible for a remedy under applicable consumer protection legislation, SIMJA will determine the most appropriate resolution having regard to the individual circumstances of the claim.

 

Fraud Prevention

To help protect customers, SIMJA, and our authorised third-party providers, we may retain and use reasonable records relating to orders, fulfilment, shipping, and communications for the purposes of investigating suspected fraud, payment disputes, or chargeback claims.

Such records may include:

  • Production records;

  • Fulfilment records;

  • Shipping records;

  • Tracking information;

  • Delivery confirmations;

  • Photographs;

  • Customer correspondence; and

  • Other evidence reasonably necessary to investigate the matter.

Any personal information will be collected, stored, and used in accordance with SIMJA's Privacy Policy and applicable privacy legislation.

Independent Assessment

The outcome of a chargeback or payment dispute is determined by the relevant payment provider, financial institution, card issuer, or other authorised dispute resolution body.

SIMJA will cooperate with those processes and provide relevant evidence where appropriate.

Any decision made through a payment dispute process does not prevent either party from exercising any additional rights or remedies available under applicable law.

 

 

25. Fraud Prevention

SIMJA is committed to providing fair, honest, and transparent customer service.

To help protect our customers, our business, our authorised third-party providers, and the integrity of our Products, SIMJA may take reasonable steps to investigate suspected fraudulent, abusive, or dishonest activity relating to orders, returns, refunds, exchanges, replacements, payment disputes, or other transactions.

This section is intended to protect all parties while ensuring that genuine customer concerns continue to be assessed fairly and in good faith.

 

False or Misleading Claims

SIMJA may investigate claims where there are reasonable grounds to believe that information provided in support of a return, refund, replacement, exchange, or other request is false, misleading, incomplete, or intentionally inaccurate.

  • Photographs have been altered or do not relate to the Product supplied;

  • Damage is inconsistent with the reported circumstances;

A review does not automatically mean that fraudulent activity has occurred. Each matter will be assessed individually and fairly.

When investigating suspected fraudulent or abusive activity, SIMJA may consider relevant information, including:

Nothing in this section limits a customer's rights or remedies under applicable consumer protection legislation, nor does it prevent SIMJA from taking reasonable steps to protect its business from fraudulent or unlawful activity.

Because every order, Product, and return request is different, some decisions require the exercise of reasonable discretion to ensure that the most appropriate outcome is achieved.

No two situations are exactly alike.
