3. Definitions
For the purposes of this Copyright & Intellectual Property Policy, the following definitions apply unless the context requires otherwise.
SIMJA
"SIMJA", "we", "our", or "us" means Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, together with its successors, authorised representatives, employees, contractors, licensors, and authorised third-party providers where applicable.
Spectrum Minds
"Spectrum Minds" means SIMJA's creative collection, brand, product range, educational resources, and associated Creative Works developed to celebrate individuality, creativity, neurodiversity, inclusion, and authentic self-expression, together with any future collections or related brands introduced by SIMJA.
Creative Works
"Creative Works" means all original or adapted artistic, literary, educational, visual, digital, multimedia, audiovisual, photographic, graphic, written, or other creative content created, commissioned, curated, published, licensed, or otherwise made available by SIMJA, whether now existing or developed in the future.
Creative Works include, but are not limited to:

Original Artwork
"Original Artwork" means an original artistic work created by SIMJA, including one-of-a-kind artworks, commissioned works, limited editions, mixed media works, paintings, illustrations, drawings, and other original artistic creations.
Fine Art Prints
"Fine Art Prints" means professionally produced reproductions of Original Artwork created or authorised by SIMJA, including open editions, limited editions, signed editions, and prints accompanied by Certificates of Authenticity where applicable.
AI-Assisted Creative Works
"AI-Assisted Creative Works" means Creative Works in which artificial intelligence has been used as one component of the creative process under the artistic direction, selection, editing, refinement, or curation of SIMJA.
Products
"Products" means all physical or digital goods offered for sale, supplied, licensed, or otherwise made available by SIMJA, including current and future product lines.
Products may include:

Fine Art Prints;
-
Canvas Prints;
-
Apparel;
-
Footwear;
-
Accessories;
-
Home décor;
-
Lifestyle products;
-
Educational resources;
-
Digital Products;

Other Products introduced by SIMJA from time to time.
Website
"Website" means the SIMJA website, associated webpages, online stores, ecommerce platforms, mobile versions, digital services, and any official online presence owned or operated by SIMJA, together with any successor websites or domains.
Intellectual Property
"Intellectual Property" means all intellectual property rights recognised under applicable law, whether registered, unregistered, existing now, or arising in the future.
This includes, but is not limited to:

Trade Marks;
-
Registered and unregistered designs;
-
Design rights;
-
Moral rights;
-
Business names;
-
Domain names;
-
Trade dress;
-
Confidential information;

Know-how;
-
Databases;

Surface patterns;

Any other proprietary rights recognised by applicable law.
Copyright
"Copyright" means the exclusive legal rights that arise under applicable copyright legislation in relation to original literary, artistic, dramatic, musical, audiovisual, photographic, digital, educational, and other copyright-protected works.
Trade Marks
"Trade Marks" means registered and unregistered trade marks, logos, business names, slogans, collection names, brand identifiers, trade dress, and other signs used by SIMJA to identify its Products, Services, and Creative Works.
Designs
"Designs" means the visual appearance, artistic layout, configuration, ornamentation, textile patterns, surface graphics, shoe designs, apparel layouts, packaging, product styling, and other aesthetic features of Products or Creative Works created, developed, licensed, or owned by SIMJA.
User Content
"User Content" means photographs, reviews, testimonials, comments, social media posts, videos, artwork, feedback, or other content created or submitted by customers or visitors that references, features, or relates to SIMJA, its Products, Services, or Creative Works.
Authorised Third-Party Providers
"Authorised Third-Party Providers" means any manufacturer, printer, fulfilment partner, supplier, logistics provider, software provider, technology provider, payment processor, distributor, contractor, or other service provider engaged or authorised by SIMJA to assist in creating, manufacturing, personalising, producing, packaging, storing, marketing, processing, or delivering Products, Services, or Creative Works.
This includes SIMJA's current authorised providers and any replacement or additional providers appointed from time to time.
4. Ownership of Intellectual Property
Unless expressly stated otherwise in writing, all intellectual property rights associated with the Products, Services, Creative Works, and other content made available by SIMJA remain the exclusive property of Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, or its licensors where applicable.
The purchase of a Product, Service, Original Artwork, Fine Art Print, digital product, or any other Creative Work does not transfer ownership of the underlying intellectual property rights unless expressly agreed in writing by SIMJA.
Ownership of the physical Product is separate from ownership of the intellectual property embodied in or associated with that Product.

Unless expressly stated otherwise, SIMJA owns or controls the intellectual property rights relating to, including but not limited to:

Collection names;

Trade dress;

Product designs;

Educational resources;

Digital products;

Website content;

Product descriptions;

Marketing materials;
-
Blog articles;
-
Written content;
-
Photographs;
-
Videos;
-
Animations;
-
AI-Assisted Creative Works;
-
Website layouts and design elements; and
-
Other Creative Works developed, commissioned, licensed, or published by SIMJA, whether now existing or created in the future.
Ownership of Physical Products
Purchasing a physical Product from SIMJA transfers ownership of that physical Product only.
Unless expressly agreed in writing, purchasing a Product does not transfer or assign any:

Copyright;
-
Trade Mark rights;
-
Design rights;
-
Moral rights;
-
Intellectual property licence;
-
Commercial use rights;
-
Reproduction rights;
-
Distribution rights;
-
Adaptation rights; or
-
Other intellectual property rights associated with the Product or Creative Work.
All such rights remain the property of Beamsley & Co Limited or the applicable rights holder.
AI-Assisted Creative Works
Some Creative Works may incorporate artificial intelligence as one component of the creative process.
Where AI-assisted Creative Works are offered by SIMJA, the use of AI does not alter the ownership of any intellectual property rights held or controlled by Beamsley & Co Limited or the applicable rights holder.

Third-Party Intellectual Property
Some Products, Services, or Creative Works may incorporate or reference intellectual property owned by third parties under licence or with permission.
All third-party intellectual property remains the property of its respective owner and is used by SIMJA in accordance with applicable licences, permissions, or legal rights.
Nothing in this Policy transfers ownership of third-party intellectual property to SIMJA or to any customer.
Future Intellectual Property
This Copyright & Intellectual Property Policy applies to all current and future intellectual property created, acquired, commissioned, licensed, published, or otherwise controlled by SIMJA.
The introduction of new Products, Services, technologies, creative methods, manufacturing processes, brands, collections, or business activities does not affect the ownership of SIMJA's intellectual property unless expressly stated in writing.
5. Copyright
Unless expressly stated otherwise, all copyright in the Creative Works published, displayed, sold, licensed, or otherwise made available by SIMJA is owned or controlled by Beamsley & Co Limited or the applicable rights holder.
Copyright protects the original expression of ideas embodied in SIMJA's Creative Works and applies in accordance with applicable copyright laws.
Unless expressly authorised in writing by SIMJA, no person may reproduce, copy, distribute, adapt, publish, communicate, commercially exploit, or otherwise use any copyright-protected material beyond the rights permitted by applicable law.

Copyright protection extends to, but is not limited to:

Emails and newsletters;

AI-Assisted Creative Works;

Other literary, artistic, educational, visual, or digital works created or published by SIMJA; and

Future Creative Works developed or published by SIMJA.
Copyright Protection
Unless otherwise permitted by applicable law or expressly authorised in writing by SIMJA, copyright-protected material must not be:

Copied or reproduced;
-
Scanned or digitised;
-
Downloaded for commercial purposes;
-
Republished;
-
Distributed;
-
Shared beyond personal use;
-
Modified or adapted;
-
Incorporated into other works;
-
Used to create derivative works;
-
Commercially exploited;
-
Sold, licensed, or sublicensed;
-
Used for manufacturing or print-on-demand production; or
-
Used in any manner that infringes SIMJA's intellectual property rights.
Personal Use
Customers may enjoy and display Products purchased from SIMJA for their own personal, non-commercial use.
Personal ownership of a Product does not transfer ownership of the underlying copyright or any other intellectual property rights associated with the Creative Work.
Any use beyond ordinary personal enjoyment requires SIMJA's prior written permission unless otherwise permitted by applicable law.
Copyright Notices
Copyright notices, artist signatures, watermarks, metadata, edition numbers, Certificates of Authenticity, branding, and other ownership identifiers must not be removed, altered, obscured, or misrepresented without the prior written consent of SIMJA.
The removal or alteration of copyright management information may constitute an infringement of applicable intellectual property laws.
Future Creative Works
Copyright protection under this Policy applies to all current and future Creative Works created, commissioned, licensed, published, or otherwise made available by SIMJA.
The introduction of new artistic mediums, technologies, Products, Services, or creative processes does not affect the ownership or protection of SIMJA's copyright unless expressly stated otherwise in writing.
6. Moral Rights
SIMJA recognises and values the moral rights of creators in accordance with applicable law.
Where recognised by law, the artist retains moral rights in Original Artwork, Creative Works, and other eligible works created by or for SIMJA, regardless of whether the physical Product has been sold.
Moral rights are personal rights that exist independently of ownership of the physical Product or the transfer of copyright and continue to apply where recognised by applicable legislation.
Right of Attribution
Where applicable, SIMJA reserves the right for the artist to be identified and acknowledged as the creator of Original Artwork and other eligible Creative Works.
Customers, licensees, collaborators, publishers, and other third parties should not falsely imply authorship by another person or remove attribution where attribution is required by law or has been provided by SIMJA.
Protection Against False Attribution
No person may falsely claim authorship of SIMJA's Creative Works or represent that another individual or organisation created artwork, designs, illustrations, educational resources, photographs, videos, or other Creative Works produced by SIMJA.
Likewise, SIMJA's name, brands, or the artist's identity must not be used in a way that falsely suggests authorship, endorsement, approval, collaboration, or affiliation where none exists.
Protection Against Derogatory Treatment
Where recognised by applicable law, SIMJA reserves the right for the artist to object to derogatory treatment of eligible Creative Works.
Derogatory treatment may include unauthorised alteration, distortion, mutilation, modification, manipulation, or other treatment of a Creative Work where that treatment is prejudicial to the artist's honour, reputation, or artistic integrity.
Nothing in this section prevents reasonable resizing, cropping, or technical adjustments that are necessary for lawful personal use and that do not misrepresent, distort, or otherwise compromise the integrity of the Creative Work.
No Waiver of Moral Rights
Unless expressly agreed in writing, SIMJA does not waive any moral rights that may exist under applicable law.
The sale, licensing, reproduction, publication, or display of a Creative Work does not, by itself, constitute a waiver of the artist's moral rights.
Respect for Creative Integrity
SIMJA respectfully requests that all Creative Works be used in a manner that recognises the originality, integrity, and artistic contribution of the creator.
We encourage customers, collaborators, publishers, and authorised third-party providers to respect the artist's creative vision and the intellectual property rights associated with every Creative Work published by SIMJA.
7. Trade Marks & Branding
SIMJA's brands, trade marks, logos, slogans, collection names, and other brand identifiers are valuable intellectual property and form an important part of the identity and reputation of our business.
Unless expressly stated otherwise, all registered and unregistered trade marks, business names, logos, slogans, collection names, brand identifiers, and other distinctive branding used by SIMJA are owned by or used under the authority of Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, or the applicable rights holder.
Nothing in this Policy grants any person the right to use SIMJA's trade marks, branding, or other brand identifiers without our prior written permission.
Protected Trade Marks and Brand Identifiers
SIMJA's trade marks and branding may include, but are not limited to:

Spectrum Imagination Mary Jane Art;

Spectrum Minds;
-
Art Without Limits;
-
Minds Without Limits;

Business names;
-
Collection names;
-
Product range names;
-
Logos;
-
Icons;
-
Stylised lettering;

Graphic identifiers;
-
Brand colours where distinctive;
-
Product branding;
-
Packaging design;
-
Trade dress; and
-
Other branding adopted by SIMJA from time to time.
The absence of a trade mark symbol (™ or ®) does not indicate that SIMJA has waived or abandoned any intellectual property rights.
Permitted Use
Customers may refer to SIMJA, Spectrum Minds, and our Products for legitimate purposes such as identifying Products they have purchased, providing reviews, or discussing our Creative Works.
Such references must not:

Suggest endorsement, sponsorship, or affiliation where none exists;
-
Misrepresent SIMJA's Products or Services;
-
Create confusion about the source of Products or Creative Works; or
-
Infringe SIMJA's intellectual property rights.
Prohibited Use
Unless expressly authorised in writing by SIMJA, you must not:

Use SIMJA's trade marks or branding in connection with another business;
-
Register or attempt to register identical or confusingly similar business names, trade marks, domain names, usernames, or social media accounts;
-
Copy or imitate SIMJA's logos, branding, trade dress, or distinctive visual identity;
-
Use SIMJA's branding in advertising, marketing, or promotional materials;
-
Apply SIMJA's branding to Products or Services not supplied or authorised by SIMJA;
-
Alter, modify, or combine SIMJA's branding with other branding in a way that may cause confusion; or
-
Use SIMJA's trade marks in any manner that infringes applicable intellectual property laws.
Future Trade Mark Registrations
SIMJA may apply for, obtain, maintain, renew, or enforce registrations for trade marks, logos, slogans, collection names, product names, or other brand identifiers in New Zealand and other jurisdictions.
This Policy applies equally to:

Registered trade marks;
-
Pending trade mark applications;
-
Unregistered trade marks;
-
Common law trade mark rights;
-
Future registrations; and
-
Other protectable branding developed by SIMJA.
Nothing in this Policy should be interpreted as limiting SIMJA's right to seek additional intellectual property protection now or in the future.
Brand Protection
SIMJA actively protects the integrity of its brands and reserves the right to take appropriate action where there are reasonable grounds to believe that its trade marks, branding, or other brand identifiers have been copied, misused, misrepresented, or infringed.
Such action may include requesting removal of infringing material, issuing cease-and-desist correspondence, reporting infringements to online platforms or marketplaces, or pursuing other remedies available under applicable law.
8. Original Artwork
SIMJA creates and offers Original Artwork that represents the artist's individual creativity, skill, and artistic expression.
Unless expressly agreed otherwise in writing, the sale of an Original Artwork transfers ownership of the physical artwork only. All intellectual property rights associated with the artwork remain the property of Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, or the applicable rights holder.
Ownership of the Physical Artwork
When a customer purchases an Original Artwork, they become the owner of that physical piece of artwork.
Ownership of the physical artwork includes the right to:

Display the artwork;
-
Resell or gift the physical artwork;
-
Enjoy the artwork for personal, non-commercial purposes; and
-
Transfer ownership of the physical artwork to another person.
Ownership of the physical artwork does not transfer ownership of the underlying intellectual property or any associated rights unless expressly agreed in writing by SIMJA.
Copyright Remains with SIMJA
Unless expressly assigned in writing, all copyright and other intellectual property rights relating to Original Artwork remain owned or controlled by Beamsley & Co Limited.
The sale of an Original Artwork does not transfer:

Copyright;
-
Trade Mark rights;
-
Design rights;
-
Moral rights;
-
Commercial use rights;
-
Reproduction rights;
-
Publishing rights;
-
Distribution rights;
-
Adaptation rights;
-
Licensing rights; or
-
Any other intellectual property rights associated with the artwork.
All such rights remain reserved.
No Reproduction Rights
Purchasing an Original Artwork does not authorise any person to:
-
Copy or reproduce the artwork;
-
Scan, photograph, or digitise the artwork for reproduction;
-
Create prints or copies;
-
Produce merchandise featuring the artwork;
-
Manufacture Products displaying the artwork;
-
Create derivative works;
-
Upload the artwork to print-on-demand platforms;
-
Use the artwork for commercial purposes;
-
Mint or create NFTs based on the artwork;
-
Use the artwork for artificial intelligence training, machine learning, or dataset creation; or
-
Otherwise exploit the artwork without SIMJA's prior written permission.
Any such use may constitute an infringement of SIMJA's intellectual property rights.
Certificates of Authenticity
Where an Original Artwork is supplied with a Certificate of Authenticity, artist signature, edition number, or other identifying documentation, these form part of the provenance and authenticity of the artwork.
Customers are encouraged to retain these items in a safe place, as replacement documentation may not always be available.
The existence or absence of a Certificate of Authenticity does not alter the ownership of the intellectual property rights associated with the artwork.
Future Use and Licensing
SIMJA reserves the right to continue using Original Artwork after its sale.
Unless otherwise agreed in writing, SIMJA may continue to:

Produce Fine Art Prints;
-
Publish the artwork;
-
Display the artwork;
-
License the artwork;
-
Feature the artwork in exhibitions, books, educational resources, or marketing materials;
-
Incorporate the artwork into future Products or Services; and
-
Otherwise exercise its intellectual property rights in accordance with applicable law.
The purchaser of the Original Artwork acknowledges that these ongoing rights remain with SIMJA unless expressly transferred in writing.
Commissioned Works
Where an Original Artwork is created on commission, ownership of the physical artwork and ownership of the intellectual property rights will be determined by the written agreement between SIMJA and the commissioning client.
Unless that agreement expressly provides otherwise, all intellectual property rights remain with Beamsley & Co Limited.
Respecting the Artist's Rights
SIMJA appreciates the support of customers who purchase Original Artwork and respectfully requests that all artwork be displayed, shared, and enjoyed in a manner that recognises and respects the artist's intellectual property rights.
Customers wishing to reproduce, publish, license, commercially use, or otherwise exploit any Original Artwork should contact SIMJA to discuss licensing opportunities or obtain prior written permission.
9. Fine Art Prints
SIMJA offers Fine Art Prints featuring authorised reproductions of Original Artwork created by the artist.
Fine Art Prints allow customers to enjoy professionally produced reproductions of SIMJA's Creative Works while preserving the artist's ownership of the underlying intellectual property.
Unless expressly agreed otherwise in writing, the purchase of a Fine Art Print transfers ownership of the physical print only. All intellectual property rights associated with the artwork remain the property of Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, or the applicable rights holder.
Authorised Reproductions
Fine Art Prints are authorised reproductions of Original Artwork produced by or under the authority of SIMJA.
Depending on the Product, Fine Art Prints may be available as:

Open editions;
-
Limited editions;
-
Signed editions;
-
Artist-approved reproductions;
-
Prints accompanied by a Certificate of Authenticity; or
-
Other editions released by SIMJA from time to time.
Each Fine Art Print represents a lawful reproduction authorised by the copyright owner.
Ownership of the Physical Print
When a customer purchases a Fine Art Print, they become the owner of that physical print.
Ownership of the physical print includes the right to:

Display the print;
-
Resell or gift the physical print;
-
Enjoy the print for personal, non-commercial purposes; and
-
Transfer ownership of the physical print to another person.
Ownership of the physical print does not transfer ownership of the underlying artwork or any associated intellectual property rights.
Copyright Remains with SIMJA
Unless expressly assigned in writing, all copyright and other intellectual property rights relating to the Original Artwork and the Fine Art Print remain owned or controlled by Beamsley & Co Limited.
The purchase of a Fine Art Print does not transfer:

Copyright;
-
Trade Mark rights;
-
Design rights;
-
Moral rights;
-
Commercial use rights;
-
Reproduction rights;
-
Publishing rights;
-
Distribution rights;
-
Adaptation rights;
-
Licensing rights; or

Signed Editions and Certificates of Authenticity
Certain Fine Art Prints may include:

These features contribute to the provenance, authenticity, and collectability of the Fine Art Print.
Customers are encouraged to retain all Certificates of Authenticity and related documentation, as replacement certificates may not always be available.
No Reproduction Rights
Purchasing a Fine Art Print does not authorise any person to:

Copy or reproduce the artwork;

Scan, photograph, or digitise the print for reproduction;

Produce additional prints or copies;
-
Create merchandise featuring the artwork;

Manufacture Products displaying the artwork;

Create derivative works;

Upload the artwork to print-on-demand platforms;

Use the artwork for commercial purposes;

Mint or create NFTs based on the artwork;

Use the artwork for artificial intelligence training, machine learning, or dataset creation; or
-
Otherwise exploit the artwork without SIMJA's prior written permission.
Any such use may constitute an infringement of SIMJA's intellectual property rights.
Future Reproductions and Licensing
SIMJA reserves the right to continue producing, publishing, licensing, displaying, or otherwise using the Original Artwork and authorised Fine Art Prints.
Unless expressly agreed otherwise in writing, the purchase of a Fine Art Print does not grant exclusive rights to the artwork, prevent future editions from being released (unless expressly identified as a limited edition), or restrict SIMJA from exercising its intellectual property rights.
Respecting the Artist's Rights
SIMJA appreciates the support of customers who purchase Fine Art Prints and respectfully requests that all prints be displayed, shared, and enjoyed in a manner that recognises and respects the artist's intellectual property rights.
Customers wishing to reproduce, publish, license, commercially use, or otherwise exploit any artwork featured in a Fine Art Print should contact SIMJA to discuss licensing opportunities or obtain prior written permission.
10. Shoe Designs, Surface Patterns & Product Designs
SIMJA creates original Product Designs that combine artistic expression with functional product application.
These Product Designs represent original Creative Works and may include artwork specifically developed for footwear, apparel, accessories, home décor, educational resources, lifestyle products, and other current or future Products.
Unless expressly agreed otherwise in writing, all intellectual property rights associated with these Product Designs remain the exclusive property of Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, or the applicable rights holder.
The purchase of a Product displaying SIMJA's artwork or Product Designs transfers ownership of the physical Product only and does not transfer ownership of the underlying intellectual property.
Shoe Designs
SIMJA's shoe designs may incorporate original artwork, custom layouts, colour combinations, graphics, placement designs, textile artwork, and other Creative Works developed specifically for footwear.
Copyright and other intellectual property rights apply not only to the individual artwork but also to the overall artistic arrangement, layout, composition, and visual presentation of the finished Product.
Surface Patterns
SIMJA creates original surface patterns for use across a variety of Products.
Surface patterns may include:

Repeating artwork;

Textile patterns;
-
Seamless designs;
-
Fabric prints;
-
Decorative motifs;
-
Graphic arrangements;

Illustrative patterns; and
-
Other original pattern designs.
These patterns are protected as Creative Works and may not be copied, reproduced, extracted, adapted, or commercially exploited without SIMJA's prior written permission.
Product Graphics and Placement Designs
SIMJA's Product Designs may include original placement of artwork, graphics, illustrations, typography, branding, and other visual elements.
Protection extends not only to the individual artwork itself but also to the creative selection, arrangement, positioning, scale, composition, and presentation of those elements on a Product.
Examples include:

Collar, cuff, or pocket artwork;

Full-wrap designs;

Product panel layouts;

Apparel and Lifestyle Product Designs
SIMJA's artwork may be adapted for use across apparel, accessories, lifestyle products, home décor, educational resources, and future Product ranges.
The adaptation of artwork to different Products does not diminish or transfer SIMJA's intellectual property rights.
Each Product Design remains protected regardless of the material, manufacturing method, or Product on which it appears.
No Reproduction Rights
Purchasing a Product featuring SIMJA's Product Designs does not authorise any person to:

Copy or reproduce the Product Design;

Recreate the Product layout;

Manufacture similar Products;
-
Copy surface patterns;
-
Extract artwork for reuse;

Produce substantially similar designs;
-
Upload artwork or Product Designs to print-on-demand platforms;

Create competing Products using SIMJA's Creative Works;

Digitally recreate or trace Product Designs; or
-
Otherwise exploit SIMJA's Product Designs without prior written permission.
Any such use may constitute an infringement of SIMJA's intellectual property rights.
Future Product Designs
This Policy applies to all current and future Product Designs developed by SIMJA.
Protection extends to Product Designs created for existing and future Products, Services, technologies, manufacturing methods, artistic mediums, collaborations, collections, and business ventures.
The introduction of new Products or manufacturing technologies does not affect SIMJA's ownership of its Product Designs or associated intellectual property rights.
Licensing
Any reproduction, commercial use, manufacture, publication, adaptation, licensing, or other use of SIMJA's Product Designs requires the prior written permission of SIMJA unless otherwise permitted by applicable law.

11. AI-Assisted Creative Works
SIMJA may use artificial intelligence ("AI") as one component of the creative process when developing certain Creative Works.
AI is used as a creative tool to assist with activities such as concept development, image generation, illustration, animation, design exploration, digital enhancement, and other creative workflows.
All AI-assisted Creative Works offered by SIMJA are subject to significant human creative direction, artistic judgement, selection, editing, refinement, and curation before being published or made available for sale.

AI as a Creative Tool
Artificial intelligence is used by SIMJA to support and enhance the creative process rather than replace it.
The final Creative Works offered by SIMJA reflect the artist's creative vision, artistic judgement, and editorial decision-making.
AI-generated outputs may be substantially modified, combined with original artwork, refined, edited, curated, or incorporated into broader Creative Works before publication.
Human Artistic Direction
All AI-assisted Creative Works published by SIMJA are subject to meaningful human involvement.
This may include:

Artistic judgement;

Selection of concepts or outputs;

Editing and refinement;
-
Original artistic additions;

Composition and arrangement;

Integration with other Creative Works; and

Final approval before publication or commercial use.
The use of AI as part of the creative process does not alter SIMJA's ownership or control of the resulting Creative Works to the extent permitted by applicable law.
Ownership of AI-Assisted Creative Works
Unless expressly stated otherwise in writing, all intellectual property rights owned or controlled by SIMJA in relation to AI-assisted Creative Works remain the property of Beamsley & Co Limited, trading as SIMJA – Spectrum Imagination Mary Jane Art – Art Without Limits and Spectrum Minds – Minds Without Limits, or the applicable rights holder.
The purchase of a Product featuring an AI-assisted Creative Work transfers ownership of the physical or digital Product only and does not transfer ownership of the underlying intellectual property rights.
No Licence Granted
Unless expressly authorised in writing by SIMJA, the purchase, download, viewing, or use of an AI-assisted Creative Work does not grant any licence or permission to:

Copy or distribute the Creative Work;

Modify or adapt the Creative Work;

Create derivative works;

12. Permitted Personal Use
SIMJA encourages customers to enjoy, display, and share their genuine purchases.
Subject to this Copyright & Intellectual Property Policy and applicable law, customers may use Products and Creative Works purchased from SIMJA for their own lawful personal, non-commercial use.
Nothing in this section transfers ownership of any intellectual property rights or grants any commercial licence.
Personal Enjoyment
Customers may:

Photography and Social Media
SIMJA loves seeing our Creative Works enjoyed by our customers.
Customers are welcome to:

Share photographs of their purchases on social media;

Tag SIMJA or Spectrum Minds in their posts;

Write reviews or testimonials;

Recommend SIMJA to others; and
-
Share their personal experiences with SIMJA Products.
Where reasonably practicable, we appreciate customers crediting SIMJA when sharing photographs featuring our Creative Works.
Personal Collections
Customers may display, frame, store, preserve, or collect Original Artwork, Fine Art Prints, and other Products purchased from SIMJA.
Collectors may also resell genuine physical Products they own, provided that doing so does not imply any affiliation with or endorsement by SIMJA.
No Commercial Rights
The personal use rights described in this section do not authorise any person to:

Reproduce or copy Creative Works;

Create merchandise using SIMJA's Creative Works;

13. Prohibited Uses
Unless expressly authorised in writing by SIMJA or otherwise permitted by applicable law, no person may copy, reproduce, distribute, adapt, commercially exploit, or otherwise use SIMJA's Creative Works, Products, Designs, branding, or other intellectual property beyond the limited personal use rights described in this Policy.
The prohibitions contained in this section apply to all current and future Creative Works, Products, Services, technologies, digital platforms, manufacturing methods, and commercial applications.

Artificial Intelligence and Machine Learning

Diffusion models;

Large language models;

Computer vision systems;

Digital Distribution
You must not:

Print-on-Demand and Marketplace Services
SIMJA's Creative Works, Product Designs, surface patterns, graphics, branding, and other intellectual property must not be uploaded to, reproduced through, manufactured by, or sold using any print-on-demand service, online marketplace, digital design platform, manufacturing platform, or similar service without SIMJA's prior written permission.
This prohibition includes, but is not limited to:

Digital Assets and Emerging Technologies
Without SIMJA's prior written permission, you must not use SIMJA's Creative Works in connection with:

Non-fungible tokens (NFTs);

Blockchain-based assets;
-
Metaverse environments;
-
Virtual products;
-
Digital collectibles;
-
Gaming assets;
-
Virtual reality;
-
Augmented reality;
-
Three-dimensional modelling;
-
Digital asset marketplaces; or
-
Other current or future digital technologies designed to commercialise or distribute Creative Works.
Circumvention
You must not knowingly assist, encourage, facilitate, or enable another person to engage in any activity prohibited by this Policy.
Attempting to avoid these restrictions through modification, adaptation, reconstruction, technological means, or by using third parties will be treated as a prohibited use.
Written Permission
Any use outside the limited personal use rights described in this Policy requires SIMJA's prior written permission.
Permission may be granted, refused, or made subject to conditions at SIMJA's discretion.
Unauthorised use of SIMJA's intellectual property may constitute an infringement of copyright, trade mark rights, design rights, or other intellectual property rights and may result in legal action or other remedies available under applicable law.
14. Marketplace & Print-on-Demand Protection
SIMJA's Creative Works are developed for authorised use on Products created, sold, or licensed by Beamsley & Co Limited.
To protect the originality, commercial value, and integrity of our Creative Works, SIMJA strictly prohibits the unauthorised reproduction, manufacture, distribution, or sale of its artwork through third-party marketplaces, print-on-demand services, manufacturing platforms, or similar commercial services without prior written permission.

Unless expressly authorised in writing by SIMJA, you must not upload, reproduce, manufacture, sell, distribute, publish, or otherwise make SIMJA's Creative Works available through any third-party marketplace, print-on-demand service, manufacturing platform, or similar commercial service.
This prohibition applies regardless of whether:

The artwork has been modified;

Colours have been changed;
-
The design has been resized or rearranged;

Only part of the artwork is used;

The Product differs from the original Product offered by SIMJA; or
-
The Creative Work has been incorporated into another design or Product.

No Manufacturing Rights
The purchase of a SIMJA Product does not grant any right to:

Reproduce the Product;

Manufacture similar Products;

Arrange production through another manufacturer;

Create print-on-demand versions of SIMJA's Creative Works;

Commission another business to reproduce SIMJA's artwork;

Produce commercial merchandise featuring SIMJA's Creative Works; or

Authorise another person or organisation to do any of these things.
All manufacturing, reproduction, and commercial exploitation rights remain exclusively with SIMJA unless expressly assigned in writing.
Commercial Licensing
Businesses, manufacturers, retailers, distributors, educators, publishers, or other organisations wishing to reproduce or commercially use SIMJA's Creative Works should contact SIMJA to discuss licensing opportunities.
Any commercial licence must be approved by SIMJA and confirmed in a written agreement before any use takes place.
Protection of Creative Integrity
SIMJA invests significant time, creativity, skill, and resources into developing original artwork and Product Designs.
Unauthorised reproduction through third-party marketplaces or manufacturing services may infringe copyright, design rights, trade mark rights, contractual rights, or other intellectual property rights recognised under applicable law.
SIMJA reserves all rights to protect its Creative Works and may take appropriate action in accordance with the Enforcement section of this Copyright & Intellectual Property Policy.
15. Artificial Intelligence, Machine Learning & Data Use
SIMJA recognises the rapid development of artificial intelligence and emerging technologies.
To protect the originality, integrity, and commercial value of our Creative Works, SIMJA expressly prohibits the unauthorised use of its intellectual property for artificial intelligence, machine learning, automated analysis, dataset creation, or similar technologies unless prior written permission has been obtained.
This section applies to all current and future Creative Works, Products, Services, technologies, and methods of automated data processing.
Prohibited AI and Machine Learning Uses
Unless expressly authorised in writing by SIMJA, you must not use any Creative Work, Product Design, artwork, photograph, illustration, video, educational resource, website content, or other intellectual property owned or controlled by SIMJA for:

No Licence for AI Use
Nothing in this Copyright & Intellectual Property Policy, our Terms & Conditions, the purchase of a Product, access to our Website, or any other interaction with SIMJA grants any licence, permission, consent, or implied right to use SIMJA's Creative Works for artificial intelligence, machine learning, automated processing, or dataset creation.
Any such use requires SIMJA's prior written permission.
Respect for Intellectual Property
SIMJA's Creative Works are created through significant artistic skill, creative judgement, and human direction.
The use of those Creative Works for artificial intelligence or automated learning technologies without authorisation may infringe copyright, database rights, design rights, contractual rights, or other intellectual property rights recognised under applicable law.

Future Technologies

18. Digital Products

Permitted Personal Use
Subject to this Policy and applicable law, customers may:

Store Digital Products on their personal devices;

Print copies for their own personal, household, or educational use where the Product is intended for printing;

Future Digital Products
This section applies to all current and future Digital Products and digital services developed by SIMJA, regardless of the technology, delivery method, platform, or format used.

Customer Ownership
Customers retain ownership of the original content they create.

Permission to Repost
Where a customer:

the customer grants SIMJA a non-exclusive, worldwide, royalty-free, revocable licence to:

Publish the User Content on SIMJA's social media channels;

Include the User Content in marketing materials;

Otherwise use the User Content for the purpose of promoting SIMJA, its Products, Services, and Creative Works.
This licence does not transfer ownership of the User Content to SIMJA.
Attribution
Where reasonably practicable, SIMJA will make reasonable efforts to acknowledge the creator of User Content by:

Crediting the customer's social media account;

Referring to the customer's preferred name; or

Providing another appropriate attribution where suitable.
Where attribution is not reasonably practicable, this does not affect the licence granted under this section.
Customer Responsibilities

The content does not knowingly infringe another person's intellectual property rights;

The content does not contain unlawful, defamatory, misleading, or offensive material; and

Removal Requests
SIMJA respects that circumstances may change.
If a customer no longer wishes SIMJA to use their User Content, they may contact us and request that future use of the content cease.
SIMJA will consider all such requests reasonably and in good faith.
Removal of User Content from future publications does not require SIMJA to recall, remove, or alter materials that have already been published or distributed before the request was received.
No Obligation to Publish
SIMJA is under no obligation to publish, repost, or retain any User Content.
